Stages of the process

The precise stages involved in the Transfer of Equity vary according to the circumstances. However, to help we have set out all the usual stages below:

  • Take your instructions and give you initial advice
  • Check finances are in place to fund transfer of equity if needed
  • Receive and advise on draft transfer deed
  • Carry out searches if needed
  • Make any necessary enquiries of the other side solicitor if needed depending on the nature of the transfer
  • Go through conditions of mortgage offer with you if a mortgage is needed
  • Send final transfer deed to you for signature
  • Agree completion date (date from which you own the property outright or dispose of your property)
  • Arrange for all monies needed to be received from lender and you if needed
  • Complete Transfer of Equity
  • Deal with payment of Stamp Duty/Land Tax if needed
  • Deal with application for registration at Land Registry if needed
